RELEASE AND
WAIVER
In consideration for the Marquette Yacht Club accepting my entry and for participation in the 2009 Ensign Fleet No. 35 Summer Race Series, and being fully knowledgeable of the risks of competitive sailing, I hereby agree:
1. To be bound by The
Racing Rules of Sailing (2009-2012), the 2009 Ensign Fleet No. 35 Racing
Instructions, and by all other rules that govern this event. I specifically acknowledge that Rule 4 of
Part 1 of The Racing Rules of Sailing places the responsibility for a decision
to participate in a race or continue racing on the skipper of each individual
boat.
2. To indemnify and hold
harmless the Marquette Yacht Club, the Ensign Class Association, Fleet No. 35
of the Ensign Class Association, U.S. Sailing, the Marquette Yacht Club Race
Committee, all members and officers of said organizations and all volunteer
personnel assisting in the Regatta, from and against any losses or liabilities
that in any way result from my participation in the 2009 Ensign Fleet No. 35
Summer Race Series.
3. I do hereby state that I am currently a full
member in good standing of the Marquette Yacht Club, the Ensign Class
Association and Ensign Fleet No. 35, and have paid any and all dues and fees as
required by said organizations.
If any provision of this Release and Waiver Agreement is
finally found unenforceable, said provision will be severed without affecting
the remaining provisions.
